5282
§ 4.71a Schedule of ratings—musculoskeletal system.

Hammer toe

A deformity where one or more toes bend downward at the middle joint.

What the rating means

VA rates hammer toe under diagnostic code 5282. There are two possible ratings: 10% or 0%. The 10% rating applies when all toes on one foot are affected and there is no claw foot present. If only a single toe is affected, the rating is 0%. The distinction between these two levels comes down to how many toes are involved. Because the rating schedule uses the word "unilateral," the 10% rating covers one foot at a time. If both feet are affected, each foot would be evaluated separately under this same code. No intermediate ratings exist between 0% and 10% for this condition.

Evidence that helps

To support a 10% rating, medical records and examination findings would need to show that all toes on the affected foot have hammer toe deformity and that claw foot is not present. A VA or private examination that documents the number of toes involved and confirms the absence of claw foot directly addresses both criteria. Imaging such as X-rays can help confirm the structural deformity across all toes. For a single affected toe, the record would reflect only one toe involved, which corresponds to the 0% rating. Statements from you describing how the deformity affects your ability to walk, wear standard footwear, or perform daily activities can provide useful context, but the rating itself turns on the clinical findings showing which toes are affected and whether claw foot is present.

Secondary conditions
