7351
§ 4.114 Schedule of ratings—digestive system.

Liver transplant

Surgical replacement of a diseased liver with a healthy donor liver.

What the rating means

VA rates liver transplant under diagnostic code 7351. On the date you are admitted to the hospital for transplant surgery, VA assigns a 100% rating, and that rating continues for an indefinite period. One year after you are discharged, VA requires a mandatory examination to determine what rating applies going forward. Any change to your rating after that exam is governed by the procedural protections in 38 CFR § 3.105(e), which means VA must give you advance notice before reducing a rating. If you are approved and waiting for a transplant but have not yet had surgery, you are entitled to a minimum rating of 60%. After transplant surgery is complete, the minimum rating is 30%. Residuals of any recurrent underlying liver disease are rated separately under the appropriate diagnostic code and, when appropriate, combined with other post-transplant residuals under the relevant body system, subject to the anti-pyramiding rules in § 4.14 and this section.

Evidence that helps

To support the 100% rating from the date of hospital admission, medical records showing the date you were admitted for transplant surgery are the core evidence. Discharge summaries and operative reports confirm that surgery took place and establish when the one-year post-discharge period begins. For the 60% minimum rating while awaiting surgery, records showing that you have been evaluated, listed, and approved as a transplant candidate are key. After surgery, records from the mandatory VA examination one year post-discharge will drive the follow-on rating. Those exam findings should document your current liver function, any ongoing symptoms, and any residuals of the underlying liver disease. Lab results such as liver function panels, imaging studies, and notes from your treating physicians about how your condition affects daily activities and work can all help show the severity of residuals that may support a rating above the 30% post-transplant minimum.

Secondary conditions

Conditions that are often caused or made worse by this one. If you have any of these, they may be claimable as secondary service connection.
