§ 4.124a Schedule of ratings—neurological conditions and convulsive disorders.

Myoclonic jerks (paramyoclonus multiplex)

A condition causing sudden, involuntary muscle jerks or twitches throughout the body.

What the rating means

Paramyoclonus multiplex, also called convulsive state, myoclonic type, is rated under diagnostic code 8104 in VA's schedule of ratings for neurological conditions and convulsive disorders. The regulation rates this condition as a tic, convulsive, severe case, which carries a single rating of 60%. Because the regulation directs that this condition be rated as a tic, the actual rating criteria come from that separate tic formula rather than from criteria written specifically for paramyoclonus multiplex. There is no tiered scale of lesser percentages listed under this code; the regulation provides only the one 60% level for severe cases rated in this way. Before any rating action is taken on an epilepsy or convulsive disorder, VA regulations require a thorough review of the preface sections covering those conditions.

Evidence that helps

Because this condition is rated as a tic, convulsive, severe case at 60%, evidence that reflects the severity and frequency of your myoclonic jerks is most relevant. Medical records documenting the nature, frequency, and intensity of the convulsive episodes help establish that the condition meets the severe standard. Neurological examination findings, including any electroencephalogram or other diagnostic testing results that confirm the diagnosis and characterize the episodes, support the picture of severity. Treating physician notes describing how often episodes occur and how disabling they are carry weight. Statements from you or people who witness your episodes describing how the jerks affect your ability to work, perform daily tasks, or maintain safety are also meaningful, since they speak directly to the functional impact that separates a severe presentation from a milder one.

Secondary conditions

Conditions that are often caused or made worse by this one. If you have any of these, they may be claimable as secondary service connection.
