Foreclosure delayed 180 days after death

A mortgage holder cannot begin foreclosure on a home owned or partly owned by a service member who dies while deployed overseas until 180 days after the death.

There is nothing to apply for. Notify the mortgage holder of the death and cite the state law if foreclosure is threatened.

What you'll need

The death certificate or report of casualty, and documentation that the service member was deployed overseas on active duty.

Eligibility

  • The service member was serving on active duty in the U.S. Armed Forces
  • The service member died while deployed overseas
  • The property is owned or partly owned by the service member
