Charges deferred and then dismissed on successful completion of treatment

If you are facing criminal charges in Delaware you may be offered a place in a court program that diverts you from the ordinary criminal justice system into treatment. Your charges are deferred while you complete a treatment plan, and dismissed once you do. You have to comply with the court-ordered treatment and appear for regular progress assessments; not complying leads to sanctions ranging from an admonishment to being removed from the program.

How to apply

You cannot apply directly. Referrals come from the Attorney General’s Office or the Office of the Public Defender, so raise it with your defence attorney. The Delaware Office of Veterans Services can explain the program on 302-739-2792.

What you'll need

Your DD214 or other proof of service, and your case details for the referring office.

Eligibility

  • You are a veteran facing criminal charges in Delaware
  • You have been referred to the program by the Attorney General’s Office or the Office of the Public Defender
  • You agree to participate voluntarily and to comply with court-ordered treatment and regular progress assessments
