Exemption from Civil Process for Pennsylvania National Guard Service Members

Pennsylvania courts, under state law
Civil process suspended during state active duty and for 30 days afterward

No civil process can be issued or enforced against you while you are on state active duty with the Pennsylvania National Guard, or until 30 days after you are released from that duty.

There is nothing to apply for. If civil process is served on you, show the court your state active duty orders or release paperwork.

Your state active duty orders, or your release from active duty paperwork showing the date you were released.

Eligibility

  • You are a Pennsylvania National Guard service member
  • You are on state active duty, or you were released from state active duty less than 30 days ago
