Retirement Income Exclusion for Military Survivor Annuities

Up to $35,000 under age 62 with a qualifying permanent disability; up to $35,000 at ages 62 to 64; up to $65,000 at 65 and older

Survivor Benefit Plan and related military survivor annuities count as taxable income in Georgia, but surviving spouses who meet an age or disability test can exclude a large part of it.

What you'll need

Your Form 1099-R for the annuity, proof of age, and documentation of a permanent disability if you are claiming under age 62.

Eligibility

  • You receive an SBP, RCSBP or RSFPP survivor annuity, and you are either 65 or older, 62 to 64, or under 62 with a permanent disability that prevents you from working
