Illinois Family Military Leave Act

Your Illinois employer, under state law
Up to 15 or 30 days of unpaid leave, by employer size

When your service member is on state or federal deployment orders, your employer must give you unpaid family military leave. Employers with at least 15 but no more than 50 employees give up to 15 days; employers with 51 or more give up to 30 days. Give your employer 14 days’ notice, and use up your vacation, personal, compensatory and other leave first, though sick leave and disability leave do not count.

What you'll need

The service member’s deployment orders and proof of your relationship to them.

Eligibility

  • You are the spouse, parent, child or grandparent of a service member
  • The service member is on state or federal deployment orders
  • Your employer has at least 15 employees
  • You have used your vacation, personal and compensatory leave first
