Kentucky Leave of Absence for National Guard Service Members for Active Duty or Training

Kentucky employers, under state law
Unpaid protected leave with reinstatement to your former position

Your employer must give you a leave of absence to attend required training or serve on active duty with the National Guard. When you are released, you must be put back in your former position with the same seniority, status, pay and other rights and benefits. Employers do not have to pay you during the leave.

Give your employer your orders and request the leave of absence before you go, then contact them to arrange your return when your service ends.

Your orders for training or active duty, and your release paperwork when you return.

  • You are employed in Kentucky
  • You are serving in the National Guard
  • You are ordered to required training or active duty
