You can exclude up to $30,000 of a military survivor annuity from your New Mexico personal income tax. This covers the Survivor Benefit Plan, the Reserve Component Survivor Benefit Plan and the Retired Serviceman’s Family Protection Plan.

Eligibility

  • You are a New Mexico resident filing a New Mexico personal income tax return
  • You receive a Survivor Benefit Plan, Reserve Component Survivor Benefit Plan or Retired Serviceman’s Family Protection Plan annuity
