New York Tax Subtraction for National Guard Service Members Called to Active Duty

New York State Department of Taxation and Finance
Military pay subtracted from New York adjusted gross income for the duration of active duty

If you are a New York National Guard member called to state or federal active duty, you can subtract your military pay from your adjusted gross income for as long as that active duty lasts. Active duty for training does not qualify.

There is nothing to apply for. Take the subtraction on your New York State income tax return for the years covered by your active duty orders.

What you'll need

Your state or federal active duty orders and the Leave and Earnings Statements for the period.

Eligibility

  • You are a New York National Guard service member
  • You were called to state or federal active duty
  • Your orders are for something other than active duty for training
