North Carolina Veterans Guardianship Act

North Carolina clerks of superior court, with the Department of Military and Veterans Affairs
Court-appointed guardianship over a veteran’s finances, property and benefits

North Carolina courts can appoint a guardian for a veteran who is incompetent, for an incompetent dependent of a veteran, or for a veteran’s minor dependent. The guardian takes responsibility for their financial affairs, maintains their property, and applies for and manages the benefits they are entitled to.

How to apply

Contact the North Carolina Department of Military and Veterans Affairs on 844-624-8387 or through its online contact page, then petition the clerk of superior court in the county where the veteran lives.

What you'll need

Medical documentation of the incompetency, the veteran’s VA benefit information, and proof of your relationship to the veteran.

Eligibility

  • The veteran is incompetent, or their dependent is incompetent or a minor
  • You are asking a North Carolina court to appoint a guardian
