Members of the North Dakota National Guard Exempt from Civil Process

North Dakota courts and law enforcement, under state law
Protection from arrest on a warrant while travelling to or from duty

You cannot be arrested on a warrant while you are going to, staying at or returning from your place of official duty with the North Dakota National Guard. The exemption does not cover treason or a felony.

How to apply

There is nothing to apply for. If the situation arises, tell the officer you are travelling to or from National Guard duty and show your orders, and contact your chain of command.

What you'll need

Your military ID and orders showing you are on official duty.

Eligibility

  • You are a North Dakota National Guard service member
  • You are going to, remaining at, or returning from your place of official duty
  • The warrant is not for treason or a felony
