Military pay you receive as a Pennsylvania National Guard member ordered to state active duty because of an emergency is not taxed by Pennsylvania. The exemption covers that duty whether you perform it inside or outside Pennsylvania.

There is nothing to apply for. Leave the state active duty pay off the income you report on your Pennsylvania PA-40 return.

Your state active duty orders and the Leave and Earnings Statements covering the duty period.

Eligibility

  • You are a Pennsylvania resident filing a Pennsylvania personal income tax return
  • You are a Pennsylvania National Guard service member
  • You were ordered to state active duty because of an emergency
