Disability retirement pay you receive as a pension, annuity or similar allowance for an injury or illness that resulted from active service is not included in taxable income. This also covers VA disability compensation and pension payments made to you or your family, grants for a home designed for wheelchair living, grants for a vehicle if you lost your sight or the use of a limb, and dependent care assistance benefits.

Eligibility

  • You are a West Virginia resident filing a West Virginia income tax return
  • You receive military disability retirement pay or another VA disability benefit for an injury or illness resulting from active service
